Terms of Use

Last updated: July 13, 2026 · Terms governing use of the Cointervue website and platform for employers and candidates.

This document is provided for informational purposes and does not constitute legal advice. Have qualified counsel review before relying on it for compliance decisions.

1. Agreement and who these Terms apply to

These Terms of Use ("Terms") are a legal agreement between IO Codash Technologies Private Limited ("Codash", "we", "us") and you regarding access to cointervue.com and the Cointervue AI interview platform (the "Service").

These Terms apply differently depending on how you use the Service:

  • Employer / Customer: if you access the Service as (or on behalf of) a hiring organization—including pilots, orders, or paid subscriptions—you accept these Terms in full, including customer commercial provisions.
  • Candidate: if you access the candidate portal to take an interview invited by an employer, you accept the Candidate Terms in Section 3 (and related acceptable-use rules), together with our Privacy Policy and AI & Automated Interview Policy as presented in the consent flow. Candidate-facing provisions do not create a paid subscription or enterprise commercial contract with Codash.
  • Website visitor: browsing cointervue.com is subject to these Terms to the extent applicable to website use, our Privacy Policy, and Cookie Policy.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

Cointervue provides AI-assisted technical interview capabilities including conversational interviews, live coding assessment, structured scoring, and related HR tooling. Features may vary during pilot and early access periods.

We may update, modify, or discontinue features with reasonable notice to active customers where practicable.

3. Candidate Terms

This Section applies when you participate as a candidate in an interview conducted through the Service at an employer’s invitation.

3.1 Eligibility and accurate information

You represent that you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and that identity and contact information you provide is accurate. You must not impersonate another person or allow someone else to take the interview in your place.

3.2 Consent, recording, and AI evaluation

Before starting, you may be asked to acknowledge our Privacy Policy and AI & Automated Interview Policy and to consent to recording and AI-assisted evaluation where required. By proceeding after providing required acknowledgements and consents, you agree that:

  • Your session may capture audio, video, screen share, coding activity, transcripts, and related metadata.
  • AI may conduct or assist the interview and generate structured scores and recommendations for the inviting employer.
  • Session materials and results may be shared with authorized users of that employer and processed by Codash and its subprocessors solely to deliver and secure the Service.

If you do not provide required consents, you may be unable to start or complete the interview. Details on retention, rights, and processing roles are in our Privacy Policy.

3.3 Integrity and acceptable conduct

You agree to participate honestly and not to:

  • Use unauthorized assistance, impersonation, or tools intended to circumvent session controls or integrity checks.
  • Harass, abuse, or disrupt the Service or other users.
  • Attempt unauthorized access to systems, other candidates’ data, or employer accounts.
  • Record, copy, or redistribute interview content, questions, or proprietary materials except as permitted by the employer or applicable law.

Session monitoring and integrity features, where enabled, are disclosed in the candidate experience. Violation may result in session termination and reporting to the inviting employer.

3.4 Relationship to the employer; no employment promise

The inviting employer is responsible for its recruitment process, notices required under employment and data-protection law, and all hiring decisions. Codash provides the interview technology as a service to that employer. Completing an interview does not create an employment, agency, or contractor relationship with Codash, and does not guarantee any hiring outcome.

3.5 AI outputs and human review

AI-generated scores and recommendations are decision-support tools for the employer. They may contain errors or limitations. Final employment decisions rest with the employer. You may request human review of AI-assisted assessments through the employer where applicable law or the employer’s process provides for it.

3.6 Privacy and data rights

Personal data processing for interviews is described in our Privacy Policy. By default, interview recordings and related artifacts are deleted within 30 days after session completion unless a different period is agreed with the employer or required by law. To exercise data rights regarding your interview, contact the inviting employer first; Codash will assist as processor.

3.7 Limitation for candidates

To the maximum extent permitted by law, Codash is not liable to candidates for employment decisions made by the inviting employer, or for indirect, incidental, or consequential damages arising from participation in an interview. Nothing in these Terms limits non-waivable rights under applicable data-protection or consumer law.

4. Pilot and early access (employers)

During pilot programs, the Service may be offered with promotional pricing, limited support hours, or pre-release features. Pilot terms communicated at onboarding supplement these Terms.

Unless otherwise agreed in writing, the Service is provided without production SLA guarantees during pilot.

5. Employer / customer responsibilities

As a customer using the Service for hiring, you agree to:

  • Use the Service only for lawful recruitment and evaluation purposes.
  • Provide candidates with required notices and obtain valid consent for recording, AI-assisted interviews, and data processing before sessions begin, as required by applicable law.
  • Comply with applicable employment, anti-discrimination, and AI-in-hiring laws in each jurisdiction where you hire.
  • Review AI-generated scores and recommendations before making employment decisions; retain human oversight.
  • Ensure account credentials are kept confidential and used only by authorized personnel.
  • Not misuse the Service to harass candidates, discriminate unlawfully, or circumvent integrity controls.
  • Configure retention and access consistent with your legal obligations and inform candidates where required.

6. Acceptable use (all users)

  • No reverse engineering, scraping, or unauthorized access to systems or data.
  • No uploading malicious code or content that infringes third-party rights.
  • No impersonation of candidates or submission of false identity information.
  • No use of the Service to build competing datasets or models from our outputs without written consent.

7. Data and privacy

Our Privacy Policy describes how we handle personal data. For candidate interview data, the employer is typically the data controller / data fiduciary and we act as processor. Enterprise customers may execute a Data Processing Addendum (DPA).

Interview recordings and artifacts are deleted within 30 days by default unless a different retention period is agreed in writing with the employer or required by law.

Employers retain ownership of their data (job descriptions, candidate information they supply, configuration). Employers grant us a limited license to process data solely to provide and improve the Service as permitted by their agreement and applicable law.

We do not use customer or candidate personal data to train public foundation models.

8. Intellectual property

Cointervue, its software, branding, documentation, and rubric frameworks are owned by IO Codash Technologies Private Limited or its licensors. Except for limited rights to use the Service, no rights are granted under these Terms. Candidate interview responses and work product remain subject to the relationship between the candidate and the inviting employer, except for the limited processing license needed to operate the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." AI-GENERATED EVALUATIONS ARE ASSISTIVE TOOLS AND MAY CONTAIN ERRORS. WE DO NOT GUARANTEE HIRING OUTCOMES, CANDIDATE QUALITY, OR UNINTERRUPTED AVAILABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

Employers are solely responsible for employment decisions and compliance with laws applicable to their hiring process. Candidates acknowledge that Codash does not decide hiring outcomes.

10. Limitation of liability (employers)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IO CODASH TECHNOLOGIES PRIVATE LIMITED AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING FROM THESE TERMS OR THE SERVICE (AS BETWEEN CODASH AND AN EMPLOYER / CUSTOMER) SHALL NOT EXCEED THE FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE THOUSAND US DOLLARS (USD $1,000), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law. Candidate-specific limitations appear in Section 3.7.

11. Indemnity (employers)

Employers / customers will indemnify and hold harmless Codash from claims arising from their use of the Service, their violation of these Terms, their violation of applicable law, or their failure to provide required candidate notices or consents.

12. Termination

Either party may terminate employer access in accordance with an order form or pilot agreement. We may suspend access for material breach or security risk. Upon termination, we will delete or return customer data per our retention policy and any DPA, subject to legal retention requirements. Candidate sessions already in progress may be completed or terminated as appropriate for security and integrity.

13. Governing law and jurisdiction

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to mandatory local law, disputes shall be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh, India.

Nothing in these Terms limits rights or remedies available to you under applicable data protection and consumer laws, including the General Data Protection Regulation (GDPR), UK GDPR, India Digital Personal Data Protection Act, 2023 (DPDP), California Consumer Privacy Act (CCPA/CPRA), and other regional privacy laws where they apply to our processing of your personal data.

14. Changes

We may update these Terms. Continued use after posting constitutes acceptance of revised Terms for website and candidate-portal use to the extent permitted by law; active customers will be notified of material changes where required.
